CoquiList Terms of Service

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.

2. Changes to Terms or Services

We may modify the Terms at any time, in our sole discretion. If we do so, we'll let you know either by posting the modified Terms on the Site or through other communications. It's important that you review the Terms whenever we modify them because if you continue to use the Services after we have posted modified Terms on the Site, you are indicating to us that you agree to be bound by the modified Terms.

3. Description of Services

CoquiList provides an online classifieds platform for Puerto Rico. Our services include posting and browsing ads in various categories including real estate, jobs, services, and more. While we strive to provide a reliable platform, we do not guarantee the accuracy, completeness, or usefulness of any information on the Site or in the Services. We are not responsible for any errors or omissions in content.

4. User Accounts

To access certain features of our Services, you may be required to create an account. You are responsible for safeguarding your account, making sure that others do not have access to your password and account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss that you may incur as a result of someone else using your account, either with or without your knowledge.

5. User Content

Our Services may allow you to store, send, receive, or otherwise make available certain content, including personal information and documents related to your classified ads ("User Content"). You retain all rights and are solely responsible for any User Content you make available through the Services.

6. Payment and Renewal

We offer both free and paid Services. By selecting a paid Service, you agree to pay CoquiList the fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up for the Service and will cover the use of that service for the period indicated. Service fees are not refundable.

7. Automatic Renewal

Unless you notify CoquiList before the end of the applicable subscription period that you want to cancel a Service, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee using any credit card or other payment mechanism we have on record for you.

8. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection, and arrangement thereof), are owned by CoquiList, its licensors or other providers of such material and are protected by Puerto Rico and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

9. Termination

We may terminate or suspend access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

10. Disclaimer of Warranties

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

11. Limitation of Liability

In no event shall CoquiList, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Puerto Rico, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Email Communications

By creating an account, you agree that we may send you transactional emails necessary to operate the Services (such as sign-in links and message notifications) and periodic email news digests. You may opt out of non-essential emails, including the news digest, at any time through your account settings or by using the unsubscribe link included in every digest email. Opting out of non-essential emails will not affect transactional emails required to provide the Services.

15. Rewards Program

CoquíList offers a rewards program ('Program') through which users can earn points for various activities on the platform. These points can be redeemed for rewards, including but not limited to cash, discounts, and other benefits as determined by CoquíList.

The Program, including point accrual rates, redemption values, and available rewards, may be changed, modified, or discontinued at any time at CoquíList's sole discretion. CoquíList reserves the right to terminate or suspend any user's participation in the Program for any reason, including suspected fraud or abuse.

Points have no cash value and are not transferable. The redemption of points for rewards is subject to availability and any additional terms and conditions associated with specific rewards. CoquíList is not responsible for any tax implications that may arise from earning or redeeming points.

By participating in the Program, users agree to these terms and any additional Program rules or guidelines that CoquíList may establish. CoquíList reserves the right to interpret and apply the Program rules and to make final decisions on any disputes or discrepancies.

SMS Messaging

Learn about our SMS messaging program

• Message frequency: Approximately 2 messages per month
• Phone numbers are securely stored and encrypted in our database
• We share phone numbers with our SMS service provider solely for the purpose of message delivery
• You may opt out at any time by replying STOP to any of our messages
• We retain your phone number until you opt out or request deletion of your account
